1. Acceptance of Terms

By accessing or using the Site and our services, you confirm that you are at least 18 years old, or that you are using the Site under the supervision of a parent or guardian, and you agree to be bound by these Terms and our Privacy Policy. If you accept these Terms on behalf of a company or organization, you represent that you have the authority to bind that entity.

2. Our Services

Creative Skies designs and produces drone light shows and related aerial entertainment for events, brands, cities, and celebrations. All shows are subject to Federal Aviation Administration (FAA) regulations, applicable local permits, airspace approvals, weather conditions, and safety requirements.

Descriptions, imagery, pricing examples, and estimates on the Site are for general information only and do not constitute a binding offer. The specific scope, price, and terms of any show are set out in a separate written proposal or service agreement.

3. Quotes, Bookings, and Payments

Quotes provided through the Site or by our team are estimates and are valid for the period stated in the quote. A show is not confirmed until a written agreement is signed and any required deposit is received. Payment terms, deposits, and refund conditions are defined in your individual service agreement. Prices are subject to change until a booking is confirmed.

4. Cancellations, Weather, and Safety

Drone shows depend on safe flying conditions. We reserve the right to delay, shorten, reschedule, or cancel a show when weather, wind, airspace restrictions, equipment issues, or safety concerns require it. The safety of the public, the crew, and the airspace is always our first priority. Rescheduling and cancellation terms, including any weather policy, are governed by your service agreement.

5. SMS / Text Messaging Terms

These SMS terms describe how the Creative Skies text messaging program works and form part of these Terms of Service. By opting in, you agree to these SMS terms.

• Program: When you provide your mobile number and opt in, Creative Skies may send you text (SMS) messages, including replies to your inquiry, quote and booking updates, appointment and event reminders, scheduling and service notifications, and, where you separately agree, promotional and marketing offers.
• How you opt in: You opt in by providing your mobile number and checking the SMS consent box on our forms, or by texting a keyword to our number. Messages may be sent using automated technology. Consent to receive marketing text messages is not required to purchase any product or service.
• Message frequency: Message frequency varies depending on your interaction with us.
• Cost: Message and data rates may apply, based on your mobile carrier plan. Creative Skies does not charge for the messages, but your carrier may.
• Opt out: Reply STOP to any message to unsubscribe at any time. You will receive one confirmation message and then no further texts unless you opt in again.

• Privacy: We do not sell, rent, or share your mobile opt-in information or SMS consent with any third parties or affiliates for their own marketing purposes. See our Privacy Policy for how we handle your information.
• Carriers: Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier's network and coverage.
• Eligibility: You must be the account holder of, or have authority to consent for, the mobile number you provide, and you must be at least 18 years old to opt in to marketing messages.

6. Email Communications

When you provide your email address and, where required, opt in, Creative Skies may send you newsletters, quotes, updates, and promotional emails through a third-party email platform such as Mailchimp. Every marketing email includes an unsubscribe link, and you can opt out at any time by clicking it or by emailing shows@creativeskies.com. We may still send transactional messages, such as replies to your inquiry or booking confirmations, even after you opt out of marketing emails.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, video, and the Creative Skies name and marks, is owned by or licensed to Creative Skies and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission. We may capture photos and video of our shows for promotional use. Where a client agreement addresses show footage, that agreement controls.

8. Acceptable Use

You agree not to use the Site or our services to violate any law, infringe the rights of others, transmit harmful or unlawful content, or interfere with the operation or security of the Site. We may suspend or terminate access for conduct that we reasonably believe violates these Terms or is harmful to us or others.

9. Third-Party Services and Links

The Site uses third-party services, including form, messaging, email, analytics, and payment providers, and may link to third-party websites. We are not responsible for the content, policies, or practices of those third parties. Your use of a third-party service is governed by that party's own terms and privacy policy.

10. Disclaimers

The Site and our services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error free, or secure, or that any specific show outcome, audience turnout, or result will be achieved. Nothing in these Terms limits any liability that cannot be limited under applicable law.

11. Limitation of Liability

To the fullest extent permitted by law, Creative Skies and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising out of or related to your use of the Site or our services. Our total liability for any claim relating to the Site is limited to the amount you paid us, if any, for the specific service that gave rise to the claim. Liability relating to a booked show is governed by your signed service agreement.

12. Indemnification

You agree to indemnify and hold harmless Creative Skies and its owners, employees, and contractors from any claims, damages, losses, or expenses, including reasonable attorney fees, arising out of your use of the Site or our services, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute relating to these Terms or the Site will be handled in the state or federal courts located in California, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with an updated date. Your continued use of the Site or our services after changes are posted means you accept the updated Terms.
